An uncontested divorce is granted by the Court if:
1. At least one spouse to the marriage has been a bona fide resident of the District of Columbia for six months;
2. The spouses have voluntarily agreed to live separate and apart without cohabitation for six months before filing for divorce.
It is important to note a couple can still live under the same roof during the six month separation period so long as they do not have sexual relations during this time.
