Uncontested Divorce

If you and your spouse have decided it is best to end your marriage, one of the quickest ways this can be accomplished in the District of Columbia is through an uncontested divorce.

An uncontested divorce is granted by the Court if:

1. At least one spouse to the marriage has been a bona fide resident of the District of Columbia for six months;

2. The spouses have voluntarily agreed to live separate and apart without cohabitation for six months before filing for divorce.

It is important to note a couple can still live under the same roof during the six month separation period so long as they do not have sexual relations during this time.
